Our new signing Jonas Gutierrez is refusing to allow his transfer to Newcastle be dampened by the potential law suite his former club Real Mallorca have indicated they will launch against him.

Jonas Gutierrez - he did everything above board
Jonas talked to the Newcastle Journal this morning:
“My conscience is clear and I am not worried by the actions of Real Mallorca.”
“I just want to play for Newcastle in the Premier League.â€
Newcastle have done absolutely nothing wrong legally, but Mallorca are obviously upset they got so little for their best player, after almost selling him to Portsmouth in January for £8M (10M euro).
Of course, to make things worse for Mallorca, the club is in dire financial straights right now, with former chairman Freddy Shepherd ready to buy the club.
Mallorca President Vicente Grande has threatened to report both Newcastle and the player to FIFA in a bid to claim the £8m in compensation he believes they are entitled to. But Gutierrez only took advantage of FIFA’s Article 17 rule, and everything seems to have been legally above board.
Grande said:
“This could hurt Real Mallorca a great deal because of our financial situation,â€
“It has come at a very bad time for us.”
“We cannot understand the attitude of the player who has done this to force a move to England. This issue is certainly not closed.”
“The club will be contacting FIFA because we believe we have a very sound case.”
“The minimum we want to recuperate is the 10 million euros Portsmouth offered us in the winter market.â€
The Journal today says the issue is further complicated because Gutierrez is still partly owned by Argentinian club Velez Sarsfield, who will also expect to receive part of any fee.
The 24-year-old was due to return to Velez this summer following a three-year loan deal with Mallorca, but his decision to buy out his contract means he is able to move to England instead.
Velez Sarsfield president Alvaro Balestrini explained:
“Jonas Gutierrez was due to return to Velez Sarsfield on 1st July in accordance with the contracts signed with Mallorca, owners of 50% of his economic rights.”
“After three seasons on loan at Mallorca he would have had to come back to Velez if Newcastle had not come in.â€
If you dismiss the grumblings of Mallorca, which are understandable in the circumstances, this seems a brilliant deal by Newcastle, to get such a good player at such a low price, even though the move seems to have been rather complex.
Now who said Wise and the other two Recruitment Directors weren’t earning their money? Â
This looks like a great acquisition for the club, at an extremely low price.

Are the media annoyed that we signed a player they didn’t link us with so they invent a story? Any business is for sale at the right price, especially at a £200 million profit! Why would he put a structure in place geared around youth development and longevity and also invest in new signings if he is planning on selling?
There are no concerns amongst the Newcastle fans over this! We simply realise now that the media has a small minded agenda which is designed to disrupt and stir trouble. For the first time in a long time we are being run like a “proper†club. We don’t broadcast our intentions like Harry redknapp and peter storie do! The media are somehow confusing our stubborn stance with regards to quotes and info drip fed to the media hacks with secret talks with various foreign investors. It must be a slow news day! Nothing like a good old Newcastle story to shift the rags! On with our lives fellow toon fans!

The problem isnt spending the money its the quality of the player. If we can get players of the same quality as Gutierrez for pennies then i for one am not complaining. More money to spend when (or if) we break into the top 4 in a few years.

Broon Ale - I always used to have exactly the same stance as yourself, but I’m not so sure anymore. The story is on BBC now and they never print just speculation. I’m beginning to think maybe he is just in it for a fast buck. I really hope not, as for the first time in a long time it looks as though we are heading in the right direction.

On the subject of Latin Players:
in the last week I watched the 2 games of the Finals of the Libertadores Cup.
Fluminense VS. LDU
And I saw 2 great players, one from each team.
On LDU - Joffre Guerron, this player have speed, power, creativity, passing, everything !!!
and on the Brazilian side- Thiago Neves.
this player, gave a chance to his team with a hat-trick in 45 minutes.
After the first game ended 4-2 to LDU
the second one ended 3-1 to Flu (after 0-1 to LDU already).
Anyway, who ever likes to follow great young players, I suggest these 2. specially Guerron,
would be so happy if Newcastle sign someone as good as he is.

A couple of quick things about the Webster case.
1. It established that when a player canceled his contract without cause then compensation was due to the club as while it was permissible to cancel the contract, it was still a breach of contract by the side that cancelled.
2. The Market Value of the player is not owed to the club. This is partly because either side can decide to cancel the contract, but imagine if you had a situation where the club could cancel and owe the player a million, but if the player canceled he owed the club 10 million - not so unilateral. So the compensation is either the remaining guaranteed payments or the amount specifically written into the contract for this eventuality (something I think you will see hapening more and more).
3. If the player then goes to another club the other club is equally liable for the compensation.
4. The contract between a club and player is subject to the FIFA regulations and is a specific type of employment contract, not a commercial contract, making it hard to sue based on lost profit or income.

Well MA has invested as he’s bank rolled Dennis Wise, Jiminez and Vetere to sort out recruitment. I’m sure there wages are around £3m a year altogether, then add on the expenses and scouting staff underneath them, as well as legal fees etc etc. It seems like they’ve justified there job roles by landing Jonas for around £4m when we was valued at £8m. If we do sign Inler for £4m, then again, pretty damn good business.
I doubt MA will sell. No body in there right mind would buy Newcastle for £420m when we aren’t even as big a brand aa any of the truly big clubs!
Didn’t Liverpool cost in the region of £420m?

I don’t think Ashley would be taking a new, more active role in the running of the club if his plan is to sell it.
His new “hands on” role suggests to me that he is in it for the long haul. Stepping in to make sure that Taylor gets a new contract in not the action of a man who doesn’t give a toss about the club.
I like the fella. I think he’s vastly improved the way the club is run.

I think this will open the floodgates for similar signings in the near future. Its going to create a lot of problems for a lot of clubs, losing their future stars for peanuts.
As the Arseing Whinger said, its going to change the way players and clubs do business.
It still looks like we got a bloody good player for not a lot of money, but what goes around, comes around and we cant complain if/ when it happens to us!!!

the mood amongst fans seems to fluctuate between delight and despair. the other day when we signed Jonas we were on top of the world. Now as a result of the story in the sun fans are once again concerned. I wouldnt let the sun influence you in any way! we have seen these stories plenty of time in the past! As for the BBC, they are no better or worse than skysports!

Ashley doesnt have anything else on his mind except selling the club, he doesnt care about newcastle at all. I personally think he will be away with his cash within the next 12months max. Of course he is trying to run the club the way it shud be done, but none of the other clubs are doing it the way he is, next year we wont be anything better than we have for the last 5seasons. Ashley is pissed off bcoz he had to pay off all that debt he didnt know about, and thats why he isnt plying the club with cash. I dont disagree with the way he is running the club but the way he is going about it isnt goin to get us a european place.

If that figure has been leaked by Ashley it does not mean stay away - it means come and get me, otherwise no price would be leaked at all.
I personally don’t think the club is for sale. But who really knows? If the price was not made up by the press and has been leaked it will mean only one thing. We are up for sale.

I agree with Davies, MA has asked for such a high price to put of portential buyers, same as a club does with a player they don’t want to lose, up the value enough to put othee teams off, works all the time
As for Jonas Gutierrez, when I first heard, I thought ‘who the hell is he’ & pretty much haven’t changed my mind yet, as there isn’t alot about him around, he scored 5 goals in 96 games, not a lot but better than Butt, Smith, Barton, Geremi have done the past 2 seasons, so lets see him work before judging him yeah!!

most of you will rememeber that i said last week that ashley would recoup his 100 million of debt within the next season and a half and then sell for 350 million and make 200 million profit. Allot of you jumped down me throat, and alot agreed. if he sells at 420 million now its exactly in line with what i said last week, he still walks away with 200 million for less than 2 years graft - not bad. Its being reported verywhere like a rash now, the bbc are reporting it too, this is normally a very good barometer for truth as they are one step up from the tabloid shite. Mark my words guys, you all know i have been saying it for ages. Do you all still feel that he’s not setting us up for a sell, its classic the way he is doing it lads, you have to trust me when i say that i know what he is going to do.

The BBC have had to apologise a few times in the last year for citing wikipedia as one of their sources in a few stories so I don’t think we should hold them in such high regard. The story is speculative, most probably taken completely out of context.
The clubs recent good business practice (and silence over current business deals) has allowed for even more speculation regarding the clubs future and administration. It’s unavoidable but a necessary means for them to sell more papers and get everyone to watch the TV.

Jeez some of you lot are so negative and so ready to believe the worst.
Go and really read the SUN article. It says the deal that was in the pipeline was killed stone dead because they wanted to buy NUFC for 320 Million and Ashley added another 100Million to the price tag. The bit of rubish is the bit that says Ashley is touting the club around the city markets. Its the other way around. There are lots of companies that would like to own Newcastle United, especially after the sterling job that the management team have done in clearing the debt at a time when structured debt deals are preparing to fall tyo pieces. (Man Utd are going to feel a lot of pain from this for the next 10 years, for them 1 season out of the top 4 in the next 10 years will see them needing to sell to survive financially). I’ve worked in a few businesses that have been successful and there are always those on the lookout to buy. This is not a new deal, it is the one that was being talked about ages ago. What has come out is that basically Mike said if you want this club off me you will have to pay me £100M more than its actually worth. That means one of two things.
Either he knows he can make it worth that much more, which means that it needs to be long term profitable and successful, or it has an emotional value to him of £100M.

I’d like to beleive that MA is in for the long haul but as Rob just said if he has stated a selling price then you would have to think if some one met this then he would sell. He is a businessman first and whilst it might be an unpalatable thought he has no real roots or connections with the region (please correct me if I am wrong). It would be a real shame as he seems to be getting the wheels back on the bus and (hopefully) getting some first class passengers in the shape of management and players. I guess we will just have to wait and hope. And if it happens, then change isn’t necessarily a bad thing.

If you were to ask most fans in the town (for those foreign fans, the town is Newcastle City Centre) what they think of MA so far. Majority will say that they will judge him, KK, Wisey and everyone else at the end of next season!

We’re not as stupid as people make out, we’re not expecting the world from our football club and we have more than realistic targets for our club. The reason why expectations are high is because our ticket prices rival those of the more succesful clubs in the league.
If we’re paying those prices, then fans think the board will justify that with intelligent, productive and hopefully exciting invetsment into the club!

Well said Craig - I never believed any of the stories until now but there does seem to be more substance to this one. Ashley may well have been making the club a more attractive option to sell on to someone else. Oh, and lets not forget they have just raked in 3 years worth of season ticket sales from a lot of fans….guaranteed income for a future investor.
And SwedeEric - I’m not 14 I’m 35 - the story is the main news on the BBC so there must be some element of truth to it. People can pretend its not happening but if the club dont announce something soon then you can pretty much take it as read that its true. Hopefully I’m wrong but you have to ask yourself how ruthless businessmen make their money - they wouldnt think twice about pulling the wool over our eyes and have no affinity to the club or its fans.

He stated a selling price in one deal that was way over the market value of the club. If someone had paid it they would have been stupid and MA would have been laughing all the way to the bank, but I suspect he knew that it would not be met.
To put it in context I was in a very good job, very happy with my employer, learning lots of good stuff, but still getting pestered by employment agents that wanted to get a commission. They would all basically get to the point at which they said, “look what will it take for you to change job” my reply was always, get me a salary of £1,000,000. Shockingly no one ever matched my price tag.

We’ll see broon ale. Mort obvoiously going to say Ashley is in it for the long run isnt he, he wouldnt come out and say ‘ ashley is looking to shift the club in the next few months’ just after he bought it would he?! Also i would take in anything that Mort has said as he knew he was only going to be at the club for the 1st 6months so he wouldn care what is going to happen in the long run. Things wont work with Ashley, i hope he proves me wrong! I lost faith in him when he got rid of allerdyce, not that i liked him either but who gets rid of there manager without having a immediate replacement. If he is running it as a business, would he sack his manager of Sports Direct without having a replacement?! I doubt it.

Read the article - it says that the price tag of 420 million killed the deal. It also sends a marker out to the market which says don’t even knock on the door unless you are going to go in for £420 Million. Which at the minute no one will go for. In the current market climate you are not going to see anyone put together a debt based buyout for an over priced asset when they are both undesirable for investors and when as a result of the uncertainty around the valuation of many businesses, the shrewd are picking off the currently heavily under priced assets. A better long term investment for anyone with 420 Million is to go into a club with a medium amount of debt, rid it of the debt and hold it for the profits over the next 5 years.

Oh - by the way, I’m not saying that MA wont sell the club in the future, nor that the changes he makes to the club will not be motivated from creating a profitable business rather than providing instant gratification to the fans.
What I’m saying is that it is not going to happen in the next 12 months and that to set the club up for a sale and maximise his return on investment he will need to set it up for success - which is what we all want.
I do readilly acknowledge that I have huge concerns over the fact that we have no say over WHO he may eventually sell it to.

The BBC now kindly oblige and present ignorant inaccurate misleading over sensationalized over politicised claptrap to the world because if they just give you facts and information they seem boring and everyone might have to face up to the fact that world isn’t actually going to end imminently and that they need to actually take some responsibility for their own lives instead of allowing it to be dictated to them by bureaucrats from around the globe and that individuals can actually make decisions for themselves.

The theory may be that £420m is genuinely Ashley’s selling price for the club - but he certainly doesn’t expect anyone will pay it now. If he gets the club into a position where it is worth that much he can sell it, do what he likes and I for one will be a happy man.
