Why Amanda Staveley May Have A Negotiating Advantage With Ashley

Amanda Staveley and her group PCP Capital Partners are now locked in negotiations with Newcastle and owner Mike Ashley as she prepares a second bid for Newcastle after the first bid she lodged last Friday was immediately rejected by Ashley.

That bid was based on a number of incentives and penalties depending on how Newcastle performed on the field.

It contained incentives for Newcastle doing well and penalties – like for instance we are relegated this season – if we didn’t do well.

There was also a penalty clause in case the tax evasion case brought by HMRC goes badly.

So all the risk was put on Ashley’s side.

Only if Newcastle met nearly all of their targets and of course also stayed in the Premier League would the price rise to £300M.

Here’s some of what was written in the National:

“Denton’s solicitors, acting for Ashley will continue negotiations with Staveley’s solicitors Freshfields to try to find a compromise deal, ideally before Christmas.”

“The present offer from Staveley’s PCP Partners has payment schedules linked to Newcastle’s performances on the pitch with Rafa Benitez’s squad needing to achieve a series of tough targets for the deal to be worth close to £300m.”

“Denton’s solicitors, acting for Ashley will continue negotiations with Staveley’s solicitors Freshfields to try to find a compromise deal, ideally before Christmas.” 

Newcastle fans are hoping a deal can be worked out and once there is a deal in principle agreed between he two parties they will be granted a period of exclusivity where the deal can be finally completed and all things are finally agreed over a period of usually around 30 days to 60 days.

The good news is that Mike has reduced his price to £350M.

The National in Dubai has reported that Staveley is using Freshfields as the lawyers for the case and they employ Chris Mort, who became Chairman at Newcastle in August 2007 after Ashley had bought the club.

He was Chairman until May of the next year when Derek Llambias came in.

The National is not indicating whether Chris Mort is involved in the actual negotiations but he knows Mike Ashley’s personality very well and could help give input on the owner and help with the deal.

That could definitely help the negotiations with Ashley.

A second offer is expected to be lodged by the end of the week – so we will see what happens.

With Mike Ashley dropping his price it does seem like he is keen on doing a deal.

A second offer has to be much closer to what the owner wants – these are a crucial few days and the last thing we want to happen is for the talks to break down.

That would be a tragedy for the club and the fans.

PCP Capital Partners are reported to be the only group serious about making an offer for the club.

    Not another picture of Amanda from her St James Park photo shoot.
    When the new Man City owners came in did they want to pay in instalments.
    No they came in and made a statement.
    Took it on warts and all and made a go of it.
    They had loads of confidence. That’s because they had loads of money.

    There are suggestions that today might be your birthday. I shan’t ask how many as it’s rude to do so. If it is your birthday, is it the real one or the official one?

    In any event, the island’ll be jumping at the weekend as hoards of revellers arrive to party with you. Make sure the ‘pharmacies’ are well stocked!

    I think they will have to compromise at around £330m as with most deals no one want to be seen as loosing or getting a bad deal. If you see a car for sale at £38,000 its up to you to negotiate with the salesman or dealership for a better price, there are even better deals at the end of the month too when sales targets are met ( Mash new purchase deals ).
    It would not surprise me if Ms Staveley gives an ultimatum to the effect take this deal or leave it as PCP will not have time to save the club if there are delays. A bit like the U.K and the E.U really dithering is no good for either side. So its all down to who blinks first and I think given the circumstances with Ashley needing money or more wallpaper to fund a new property deal ( allegedly ) our Amanda will stare him out, or at lease I hope so. Will be interesting to listen if there are any Amanda or Staveley chants on Saturday. We all need this over yesterday so we can get on with football at St.James’s again.

    be a little more positive my fellow fan.. its been hard enough
    staying positve all these years with asley at the helm now we
    got a chance off getting rid of him. if you keep it going i think
    you could end up or should be put on a suicide watch.
