I’d posted this a few threads back and my thoughts seem to chime with yours

    geordietom

Your post @34 (previous thread) referred to the OandD test and that they are looking at the people involved in the deal. You seem to be referring to human beings.

In this instance, I’d guess that they may looking at the Saudi PIF which in legal terms would be referred to as a ‘Person’. If the PIF is an arm of the Saudi state of which MBS is near the top while he seems to be head of the PIF, they could well draw the conclusion that as Saudi Arabia has not taken steps to outlaw the sale of Beout boxes then it is therefore complicit in the ‘piracy’ of BeIn broadcasts.

Just me thinking out loud – any legals looking in might like to comment?

9 has it spot on, they’d have to find a link between PIF and incoming MD for this to be blocked. Good luck in finding that

It also shows why this process isnt as straight forward as the normal 2 to 4 week process, this is arguably the most complicated takeover deal the PL has ever been involved in presiding over so expect a few more bumps and turns before hopefully being completed.

Our Toon : “possibly the most complicated deal they’ve ever had to look into” You bet! EPL survives on broadcast revenue: Qatar have all the legal rights, for a princely sum, to broadcast EPL in Mid East; Saudi, who hate Qatar,-. have been pirating these rights and everybody knows it, and now Saudi want to buy an EPL club : tricky, you have to admit. Sheff U got away with it, but their named man obviously wasn’t Yasir Al-Rumayyan.

9, we’re singing from the same hymn sheet. There would have to be indisputable proof that either the PIF or one of its officers had been responsible for BeoutQ and that officer was one of the individuals or forward for the o&d test.

The most that would happen is that the person in question would be disqualified.

I have no inside knowledge, but I’m absolutely certain that Al Rummayyan not his associates would get his hands dirty with BeoutQ directly.

I’m aware of the rivalry with Qatar, I’m also certain that the Saudis would have been very happy that BeoutQ were messing with them, but no way did they leave a paper trail to anyone important.

The worst outcome I can see from this is that the outcome of the o&d test will be delayed till the WTO report is released in full, which the guardian said was due in mid-June. However, they also said that the premier League had already had access to it, so that seems unlikely.

If it is delayed till mid June then it’ll be frustrating but not the end of the world.

Just my opinion, though, nothing to back it up.

So, Rob, we’re both in the same boat – the same as everybody else- we know nowt. It doesn’t matter in the slightest how long the EPL decision is delayed, nothing whatsoever matters except the certainty that the takeover will get the go-ahead. When? It really, truly, doesn’t matter. Patience, boys!

For those a bit worried about the WTO findings.

“The WTO insists that it is not an international court, with its focus on settling disputes through negotiations. It can impose trade sanctions on countries that ignore its rulings, but it provides little detail on how such sanctions can be applied.”

    Taken from this piece.

    https://news.cgtn.com/news/78417a4e326b7a6333566d54/share_p.html

All they’ll do is insist it is turned off. I doubt this will affect the takeover.

It’s a measure of how high we’ve already risen in the world: the WTO expressing an opinion of relevance to NUFC!
We’re about to join the big league, by which I mean the VERY BIG league: we’ll be the richest football club the world has ever seen.

Guessing this will have been posted before but in case anyone hasn’t seen it, these are the terms for the O+D test:

    https://www.efl.com/-more/governance/efl-rules–regulations/appendix-3—owners-and-directors-test/

Any body that owns more than a 30% share will be looked into, so I would assume that this means the PIF board/chairman will potentially be investigated, but unless this WTO report leads to a direct conviction (which will take some time) I can’t see anything in here that would stop it going through.

Also, oddly it seems that watching pirated football matches would exclude a person from owning a team (dishonestly receiving a programme broadcast from within the UK with intent to avoid payment under Section 297 of the Copyright, Designs and Patents Act 1988), but not running an operation that is actually responsible for broadcasting those games illegally in the first place.
