Saudis Doing Their Utmost To Get Newcastle Takeover Approved – Setting The Stage For Premier League Announcement



There’s more good news today from the Saudi government regarding the potential takeover of Newcastle United.

Their Public Investment Fund will invest 80% of the 300M to buy Newcastle, as part o a consortium put together by Ms. Amanda Staveley.

It’s a long statement on Intellectual Property (IP) rights, but it is worth reading.

Basically, they defend the Kingdom’s record on IP protection and will continue to do so.

The Saudi Authority for Intellectual Property Issues Statement is in response to the Report of the WTO Dispute Settlement Body in Case No. (DS 567).

Riyadh, Jun 23, 2020, SPA

The WTO Dispute Settlement Body circulated on 16 June 2020, regarding the case brought by Qatar about compliance with the Agreement on Trade-Related Aspects of Intellectual Property Rights (TRIPS), which vindicates the Kingdom and justifies under international law the measures that Saudi Arabia has in place to protect our country and people from terrorism and extremism.

In addition to fully accepting Saudi Arabia’s national security defense, the Panel rejected claims that Saudi intellectual property laws and regulations violated WTO rules, rejected claims that our Government supported the alleged copyright piracy, and the Panel did not find that any copyright pirate was based on our territory.

The key intellectual property question in the dispute was whether, under the circumstances of the dispute, Saudi Arabia could have applied criminal procedures and penalties to protect copyright holders’ rights. Saudi Arabia confirmed repeatedly before the Panel, that Saudi authorities took all possible measures to seize and destroy illegal set-top boxes for unlicensed distribution of digital broadcasts.

Saudi authorities pursued a multi-prong enforcement approach, including public education, deterrence by monitoring the market, investigating compliance, and seizing hardware, as well as encouraging content providers to ensure that legal means of distribution are available.

As experts on digital copyright enforcement know well, ensuring the availability of content through legal means is key to achieving compliance, together with public awareness campaigns and monitoring and enforcement activities in the market, and cross-border cooperation.

Saudi Arabia has repeatedly committed to continue to do its part to identify the illegal activity and stop copyright piracy. At the same time, the Kingdom emphasized that success in this area requires international cooperation from all parties to achieve compliance, especially because digital pirates operate globally. As Saudi Arabia made clear to the Panel, and as remains the case today, no evidence of civil or criminal copyright violation at all has been provided to the Saudi authorities exclusively responsible for enforcing intellectual property rights in Saudi Arabia, the Saudi Authority for Intellectual Property (SAIP) and the Copyright Committee.

Nevertheless, we continue to hear complaints that access is being blocked to enforcement through the Saudi legal system.

Therefore, we want to confirm how simple and transparent our process is for submitting information and claims regarding the protection of intellectual property. As Saudi Arabia confirmed on the record before the WTO Panel, in order to raise an intellectual property issue in Saudi Arabia, a right holder only needs to send an email to the responsible authorities.

As Saudi Arabia submitted to the Panel, any entity may contact SAIP through the means indicated on SAIP’s public webpage, including directly through its website: https://www.saip.gov.sa/en/contact-us/, or by email: saip@saip.gov.sa. Hundreds of companies have contacted the Saudi authorities to obtain answers to questions and to resolve intellectual property matters.

The Saudi authorities welcome all inquiries in order to ensure compliance with Saudi law and international obligations, and to promote innovation and economic development in Saudi Arabia.
Accordingly, SAIP affirms the continuation of joint national efforts on the fight against the violations of intellectual property rights in Saudi Arabia through:

First: Ensuring effective enforcement of intellectual property rights by the concerned authorities.
SAIP affirms its responsibility to register IP rights, protecting thereof and facilitating procedures for filing complaints and lawsuits through its official channels and pursuing litigation procedures through the competent court.
SAIP works on full integration of the IP enforcement ecosystem in Saudi Arabia and enhances efforts to develop and coordinate working methods between government entities and the private sector competent with IP rights enforcement.

Second: Building respect for intellectual property rights
– SAIP launches awareness campaigns to build respect of intellectual property through various media means, and organized huge events in various regions in Saudi Arabia to introduce intellectual property and build its respect within individuals and enterprises and conducts several IP workshops across Saudi Arabia.
– SAIP executes inspections campaigns on a large scale to combat violations of intellectual property rights including stores selling pirates broadcasting devices, pirated computer software. In addition to audio recording stores and websites violating intellectual property law. Moreover, SAIP works on blocking access of violating websites inside Saudi Arabia in coordination with the concerned authorities and satisfy the relevant regulatory procedures.

So basically there are defending their past record of Intellectual Property and are saying they will continue with that and do even more in the future to protect IP.

This has all come about in reality because of the Newcastle United takeover.

It also seems they are setting the stage to allow the Premier League to announce that thee Newcastle takeover has passed the owners’ and directors’ test.

We hope this will be enough to allow the Premier League to allow the takeover.

    It depends. I think the PL will let NUFC know first, but nobody knows whether the PL would make a statement at that point or wait until it’s all official after the money transfers. It’ll leak out though.

    Caulkin convinced we will all know via leak or premier league announcement when approval is finally signed off.

    The Premier League definitely won’t make any statement, it’s not their place to do so and nor have they ever previously done this. George is correct in saying it will leak. Jason Burt was the first to confirm it was with the PL. The WTO complication was first reported on by Sean Ingle. They obviously both have connections within the PL.

    How so? The obvious answer is that it is in relation to the WTO ruling that just came out. Why woukd they wait almost 3 months after the paperwork went to the PL to start dealing with piracy issues? If they wanted to make sure they were in the clear they would have done this before the bid went in.

    BeIN where using the piracy as a way to stop the Newcastle takeover as it was mostly there complaint. The WTO report came out and didn’t shine SA in the greatest light but nothing major to hold against them. They then start making movements around the world to change this ie Bidding for Serie A tv rights and putting shares into BT, plus going for Bundesliga rights. With all that they start buckling down on piracy within there country, blocking 233 illegal sites and an aim to work harder against piracy.

    These are all moves to say they are heeding to demands of the Premier League to be able to pass the test and become our new owners.

    If you think the Premier League won’t take this opportunity to stop piracy within SA, then your on another planet.

    It’s costing the league millions and would benefit them to get it sorted and also benefit the league by having Saudi investment.

    IMHO I think the PL have played a blinder, they’ve delayed long enough and made the Saudis’ relent over the piracy issues and when they do make their decision and if that decision is yes you can purchase it will put them in a good light because of their achievement.

    The thing is I don’t think PIF expected this battle from BeIN and really thought they would get it done inside the 3-4 weeks but they didn’t and BeIN will have spent a fortune on trying to derail this and they are the Premier Leagues leading broadcaster so they do kinda get a voice which needs to be listened to.

    I don’t think they ever thought they would have to do what they have done to get this deal done. But the fact that they are doing this shows how much they want this club.

    KV. Thanks for the lesson. Well aware of what I posted. I believe they are eggcorns and I was being facetious. It is actually a bugbear of mine, if utilising a turn of phrase ensure that the phrase is correct. But I was actually endeavouring to join in with THAH as I believe he was actually fully aware that the correct phrase is damp squib not damp squid.
