Newcastle Issue Brief Statement On Postponement Of Arbitration Until 2022



Newcastle United have confirmed that their pending arbitration case against The Premier League has been postponed until early 2022 after a meeting on Monday.

Here is the full statement from the club:

The parties attended a hearing today in the case between Newcastle United and the Premier League.

The main hearing of the arbitration has regrettably now been adjourned until early 2022 due to issues with the disclosure of evidence.

The parties will be making no further comment at this time.

Newcastle’s arbitration case against the Premier League was supposed to get underway this month. The timeframe of the proceedings could have lasted well into the season. Now this club will remain in limbo almost indefinitely as no firm date for the arbitration has been set.

Mike Ashley has been reluctant to fund Steve Bruce’s summer business with a reported budget of just £10m as he hopes to get the Saudi-backed takeover resurrected. We are starting to fall well behind the rest of the pack in our preparations for the coming campaign.

This is another in an endless string of delays and shenanigans that are threatening this club’s ability to compete in the league. Now that a final decision on this takeover is not likely to happen until near the end of this season, Mike Ashley has to open up his wallet and back this club.

    In the world of football a delay of up to a year is a killer as the club could implode in that time. It just puts us further behind our competition and us fans are expected to carry on as if nothing has happened. We deserve an explanation as to what this issue with disclosure is. I have my season ticket and think the best way to use it now is to take the pitch before the West Ham game and stop any football being played there, until we get a reasonable explanation from all parties. Why should we just have to accept this permanent limbo.

    There’ll be a few on here who may not be around next year to see the clubs new dawn. I know a few lost in the past year. Time waits for no man or woman. This is a form of mental torture. No explanation is simply not acceptable. We need to up our game, whilst staying within the law of course.

    I watched the final on RTE what a hurling match i honestly thought it was over at half time as Tipperary played Limerick of the park in the first half and were 10 points ahead so i turned it over to watch the golf, when i went back to RTE Limerick were leading by a point Jesus i could not believe it, what a brilliant team you have. Did you see the Armagh v Monaghan match, it was one of the best matches ive ever seen, even all the media said it was an all time classic, i was really gutted, but i like Monaghan and would have been depressed if we had been beat by Tyrone 😀 Very tragic news the young Monaghan U20s captain Brendan Og Duffy lost his life on friday to in a car accident so sad.

    They say they’d always prefer the CAT before the arbitration tribunal, but CAT could run for months, whilst the arbitration should have been a nice swift and clean 2 week process. We deserve to know where we stand. I’ll be there for West Ham and I hope we make our feelings clear. Banners the lot. We have to stay within the law but we have been far too accepting of the S*it piled onto us over the past 18 months, never mind 14 years.

    Magic I thought armagh had won! I was told incorrectly. I saw it early on when Monaghan shot into an early decent lead. As for limerick, staggering. I thought we were beaten too. These guys are like beach boys these days with the muscles. No wonder they have all the woman swooning, young and not so young!! 🙂

    Boycotting getting the West Ham game stopped or whatever plays into the hands of the EPL who wouldn’t hesitate in deducting 12 points or more and making us play behind closed doors as they would love to get rid of us
    Gutless cretins should of deducted points from the big six but oh no cannot fo that
    My own personal opinion would be to get behind the team home and away and hopefully Ashley buys a couple of decent players to keep us up and hopefully next year the lawyers go for the EPLs managements guts

    CH, I think you’re right.

    WL, it was because of last year that I had the chat. Basically, they didn’t pull out, the O&D application was withdrawn and they were committed to return when a clear path to approval was in place. The shame was (to save face) they waffled on about “the market place changing due to Covid” or some such palaver, which just muddied the waters.

    As I said, not spitting dummy out – yet. 🙂

    That was achieved but we are still stuck in limbo by a cartel run PL with there far reach and deep pockets, to me this is the club and consortium changing the game plan.

    The call for transparency by Staveley and Ghodoussi. They must of knew this was coming. There is still a few cards to be played here and it’s not over till it’s over.

    The arbitration case was surely the key. We prove separation and we’re away, we don’t and there is no deal unless the Saudis appoint their State as a director and are prepared to subject the State to the O&D tests. CAT is surely way more complex in terms of burden of proof, and would still need to prove the PIF is separate from the state, as the reason the takeover was pulled was the PLs insistence in ignoring the legal opinion on that matter from Saudi.

    We conceded 4 goals in the first 20 minutes and still came back from 8 points down half way through the second half to lead by 2 points with two minutes left, but Monaghan came back to score 4 points in time added on, even though we got beat it was an amazing exciting match played at full pace and hard hitting in the hottest day on record in the North unbelievable

    If it had of been just a run of the mill investor wanting to buy the club we would have new owners now, but for what? Owners like Burnley, or Sheff Utd, or even Sunderland?
    What would really be the point in having owners with not enough money to progress the club, or even put it on a level playing field.
    Everyone and their dog knows it`s about us potentially being the richest club in the world bar none, and the threat that carries is far too much for the greedy 6 to contemplate, hence no takeover.
    Its stating the obvious but there you go, plenty of potential new owners kicking about but….
    Then of course there is the asking price Hmmm.

    Does anyone really think that if this limbo carries on into next year we will just brainwash ourselves into thinking that nothing is going on and it’s business as usual for our happy club. We’d have to be top 6 and banging the goals in. Not going to happen on our shoestring limbo budget. Fans will be looking to blame someone and we’ll be inside grounds for the first times since this whole fiasco started. Can’t wait!

    Onmeedson, the CAT is in fact a simpler case. Basically, did the PL act anti competitively?

    By neither passing or failing the O&D tests last year, while effectively sitting on it for 15 weeks, was that behaviour anti competitive?

    Copies of letters from other big 6 clubs expressing their “reservations” about the takeover will certainly make it appear so. If the PL lose at CAT, then the court will force the takeover and it will also cost them a fortune in compo to MA. Hence the feeling that a settlement is “in the air”.

    The PL just didn’t accept the Saudi legal counsels view that PIF was separate from the State, so they were able to hold off from making a decision until the State was submitted as a Director. This never happened as there was a Mexican stand off, so they haven’t delayed the takeover unless it can be proven that the PL were wrong to reject the Saudi counsel view on separation.

    Unfortunately the premier league make the rules and are in charge of all the controls, we all know they are a law unto themselves, there is no reason why, that takeover was not approved if justice was being applied, in my opinion there is just to many influential and powerful people opposed to the takeover from the very start and thats the reason ive always been very sceptical about the takeover, we are always swimming against the tide with the premier league and their puppet masters pulling the strings.

    It’s a reasonable hypothesis and I hope it’s the correct one. But when will we know? This week by week existence waiting for something concrete is too much, and will not help the team. A week ago Staveley was wanting the arbitration in the public domain. That plea failed, so is this their next card? We have an information vacuum and the longer this persists the more volatile and toxic the situation will become.

    Trying to reason this statement, I keep asking why would Ashley agree to the adjournment? I believe he’s told the PL that if they win arbitration then the CAT case will run regardless. The CAT case will be held in public; that has been decided. I wonder if the PL think now they’re in a no win situation. They’ve seen the CAT evidence and know that we have the bullets to expose them, and this will finish them. The arbitration is an independent panel, neither the PL nor Ashley have any say in the ruling. Perhaps the PL are actually worried they win arbitration then have a CAT case following on, and know regardless the CAT case will run anyway if the takeover fails. Result the PL come to an agreement with Ashley to delay the imminent arbitration case using disclosure as a smokescreen, and are actually in talks to settle this out of court on the understanding that Ashley drops the CAT case. Just my two penneth. I think there’s more to this than meets the eye. Why would Ashley agree with the PL to a delay when he’s desperate to sell? He knows CAT will kill the PL that’s why.
